DMCA & Copyright Policy

How to report copyright infringement on Ordnary's services, and how we respond to takedown notices and counter-notices.

Ordnary respects the intellectual property rights of others and expects users of our services to do the same. This policy explains how to report content you believe infringes your copyright, how we handle those reports, and how you can respond if your own content is taken down.

For content and users in the European Union, we handle reports of illegal content, including copyright infringement, under the notice-and-action mechanism of the EU Digital Services Act (Regulation (EU) 2022/2065, the "DSA") and applicable Dutch law. For the United States, we respond to notices under the U.S. Digital Millennium Copyright Act (DMCA). Where neither framework applies directly, we apply the same processes where reasonable.

Reporting illegal content in the EU (Digital Services Act)

If you are in the European Union, or the content you want to report is available to users in the EU, you can report content you consider illegal, including copyright infringement, by emailing dsa@ordnary.com with the subject line "DSA Notice". Your report must include:

  • A sufficiently substantiated explanation of why you consider the content to be illegal.
  • The exact electronic location of the content, such as a URL, and, where necessary, additional information enabling us to identify it.
  • Your name and email address, except for reports concerning certain serious offences, which you may submit anonymously.
  • A statement confirming your good-faith belief that the information in your report is accurate and complete.

We confirm receipt of complete reports, review them in a timely, diligent, non-arbitrary, and objective manner, and inform you of our decision and the redress available to you. When we remove or restrict content, we give the affected user a statement of reasons, including the ground for our decision and how it can be contested. If you believe we decided in error, you can contest the decision by contacting dsa@ordnary.com; you may also be able to take the matter to a certified out-of-court dispute settlement body or a court.

Point of contact under the DSA

Our single point of contact for authorities of EU Member States, the European Commission, and the European Board for Digital Services, and for users of our services, is dsa@ordnary.com. You can communicate with us in English or Dutch.

Filing a DMCA notice (United States)

If you believe content hosted through an Ordnary service infringes your copyright, send a written notice to our designated agent that includes all of the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by one notice, a representative list of those works.
  • Identification of the material you claim is infringing, with enough detail that we can locate it, such as a URL or a description of where it appears within the service.
  • Your contact information, including your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Notices that don't include this information may take longer to process, or we may be unable to act on them.

Where to send a notice

Send copyright notices to copyright@ordnary.com with the subject line "DMCA Notice". We only accept notices through this channel, not through customer support or other contact methods.

What happens after a notice is filed

When we receive a complete notice, we review it and, where appropriate, remove or disable access to the material identified, and notify the user who posted or uploaded it. We may also take other steps described in our Terms of Service, including suspending or terminating accounts, at our discretion.

Counter-notification

If material you posted was removed or disabled and you believe this was a mistake or misidentification, you can send a counter-notice to copyright@ordnary.com that includes:

  • Your physical or electronic signature.
  • Identification of the material that was removed and its location before removal.
  • A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district, or, if outside the United States, any judicial district in which Ordnary may be found, and that you accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notice, we may forward it to the person who filed the original notice. Unless that person informs us they've filed a court action seeking an order to restrain the user from engaging in infringing activity, we may restore the removed material within the timeframe required by law.

Repeat infringers

We may suspend or terminate, in appropriate circumstances, the accounts of users who are repeat infringers of the intellectual property rights of others.

Misrepresentations

Filing a false or bad faith notice or counter-notice can expose you to liability for damages, including costs and attorneys' fees incurred by the party you accused, or by Ordnary as a result of relying on your notice. Only file a notice if you are the copyright owner or authorized to act on their behalf.

Trademarks

Ordnary's names, logos, and other trademarks may not be used without our prior written permission, except to accurately describe your relationship with Ordnary or refer to our products and services. This policy doesn't grant any license to our trademarks.

Other intellectual property claims

This policy covers copyright specifically. If you believe content infringes a trademark, patent, or other right, contact copyright@ordnary.com with a description of the claim, the material involved, and your contact information, and we'll review it under the process that applies to that type of claim.
